Terms and Conditions
Definitions. “Agreement” means all terms and conditions found in this form, any addenda and any additional materials we provide at the time of the reservation/rental. “You” or “your” means the person identified as the renter on this form, any persons signing this Agreement, and any person or organization to whom charges are billed by us at its or the renter’s direction. All person’s referred to as “you: or “your” are jointly and severally bond by this Agreement. “We”,” Our” or “Us” means Glacier Outdoor Rentals and Weeder Co DBA Mark Weed Auto Sales is a Montana business. “Boat” means the pontoon/tritoon boat identified in this Agreement. “Loss of Use” means the loss of our right to use the Boat for any reason because of damages to it or loss of it during this rental. Loss of use is calculated by multiplying the number days from the date of damage to it or loss of it during the rental. Loss of repaired or replaced time the daily rate.
Rental, Indemnity and Warranties. This is a contract for the temporary use of the Boat/Trailer at the Lake/Rental Location noted above. This contract does not provide you or any other party with the rights to tow or otherwise move the Boat/Trailer from the Lake/Rental location. Unauthorized towing of the Boat/Trailer will result in, at a minimum, a loss of the Security Deposit and potentially, legal action. We may repossess the Boat/Trailer at your expense without notice to you if the Boat/Trailer is abandoned or use in violation of any applicable laws or this Agreement. You agree to indemnify us, defend us and hold us harmless from all claims, liability, costs and attorney fees incur resulting from, or arising out of, regarding the Boat/Trailer, no warranty of merchantability and no warranty that the Boat/Trailer is fit for a particular purpose.
Check In. Allow up to 30 minutes for registration and walk through
Delivery. We will deliver and launch Boat at the Lake/Rental location on the Rental Period. At the time of delivery, one of our staff members will provide you with an orientation to show you are safe and proper use of the Boat and its features. The orientation process can take up to 30 minutes-please allow yourself enough time. There are no refunds for early departures. The Boat must be returned without damage and the inside must be clean prior to check out. Failure to return without damage and/or in an unclean slate will result in additional charges that may be deducted from the Security Deposit and, if necessary, additional charges may be made to your credit card. If incorrect delivery information is submitted through reservation request from that result in Glacier Outdoor Rentals delivering your rental on the wrong date or the wrong location, $100 will automatically be deducted from security deposits to cover travel costs and time spent.
Prohibited Uses. The following acts and/or uses are prohibited and constitute a breach of this Agreement subject, but not limited to, forfeiture of the security deposit, repossession of the Boat without legal process, and/or legal action: a) renter will not operate or permit anyone else to operate the Boat while under the fluence of alcohol or drugs b) no towing of any type behind the Boat c) not complying with all Fish, Wildlife and Parks rules and regulations, or State or Federal laws.
Personal Injury. You release us, our agents and employees from all claims for loss of, or damage to, your personal property or that of any other person, that was left or carried in or on the Boat or in our offices, whether or not the loss or damages was caused by our negligence or was otherwise our responsibility.
Boat Use. Weather can be variable, you must exercise caution, pre-planning and good judgement in the use of the Boat. At NO TIME should the total weight in the Boat exceed the maximum listed weight as marked on the plate inside of the Boat.
Smoking. There is NO SMOKING on any of the Boats. If the Boat is returned with ANY kind of smoking order or burn marks, it will result in the forfeiture of the security deposit plus any additional charges incurred in cleaning and/or repair.
Limited Supplies. Our Boats approximately hold 8 to 20 gallons of fuel. This amount of fuel and comfortable speed should last a full day rental
Fuel. If you decide to refuel the Boat, any spills, waste of fuel, or damage will your responsibility. We recommend pulling the Boat out and refill or refill at gas station on lake, if one is available
Delivery Option. We will delivery our Boats to lakes not on our list for $3.00 a mile round trip
Renter Damage. If the Boat and/or contents in the Boat at the time of delivery orientation are damaged during your rental period, you are responsible to pay all damage cost whether you were at fault or not or if damage was caused by acts of nature (wind, rain, earthquake, fire, etc.…) If an accident occurs, you are responsible for obtaining a police report, and contacting us immediately 406-314-5706 or 406-257-2978. At check out, Glacier Outdoor Rentals will estimate the damage, if any and expedite the cleaning and/or repairs
Early Departure/Extending Rental Dates. You are responsible for reviewing this Agreement to ensure that all rental costs and rental dates are correct. If you wish to extend the Rental Period, you must call us for approval. There are NO REFUNDS for early departures. If you are not in boat launch area at scheduled Pick Up time on the scheduled Rental Period End Date and you have not called us for approval to extend the rental period, you will be charged additional rental day(s), and any inconvenience fees incurred by the next renter
Refunds. No refund will be given for any reason, including, but not limited to, no shows, late arrivals, or early departures.
